HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 4490 of 2016 Order:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner states that he belongs to landless poor family of interior Nellore district. In May 2015, he migrated to Secunderabad to work as a watchman in Plot Nos.27 and 28 of Ganesh Nagar, West Marredpally, Secunderabad. His second daughter had high fever on 21.10.2015 and she was taken to the 9th respondent hospital. She was put in ICU and, without doing any treatment, an amount of Rs.6,00,000/- was charged and a further amount of Rs.3,00,000/- was demanded. The petitioner was not allowed to see his daughter. The petitioner came to know that the girl died three days back and the whole body was bloated. It is the case of the petitioner that due to negligence of the hospital authorities the girl died. In respect of the same, the petitioner states that he lodged a complaint to the respondents and when no action was taken the present Writ Petition was filed.

A perusal of the array of the respondents shows that the concerned Station House Officer was not made as a party to the Writ Petition and the Director General of Police of both the States were made as parties. Since proper officer was not made as a party, liberty is given to the petitioner to file fresh complaint with the concerned Station House Officer in respect of the incident that had happened, for which a complaint was already lodged on 05.11.2015, and on receipt of the same the concerned Station House Officer shall take up the investigation and proceed with the matter in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
