HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU CIVIL REVISION PETITION No.3238 of 2018 ORDER:

This Civil Revision Petition is filed against the order dated 26.04.2018 passed in I.A.No.157 of 2018 in O.S.No.141 of 2014 on the file of IV Additional District Judge Vizianagaram. The essential grievance, of the learned counsel appearing for the petitioners, is that the lower Court allowed receipt of documents after plaintiffs evidence and did not consider the objections that are raised. He submits that these documents are available with the party but they were not filed earlier nor is there adequate pleading about these documents.

At this stage, this Court is not going into the merits of each of the document. Suffice it to say that the Court below permitted the petitioners herein to raise every objection to the marking of the documents. Therefore, there is no reason for the filing of the CRP in the view of this Court. It is made clear that the petitioners are given liberty to raise all the objections that they have for the marking of the documents. The Court shall decide the issues at the appropriate stage depending on the objection in line with the decision of the Hon'ble Supreme Court of India in Bibin Shantial Panchal vs. State of Gujarat1.

With these observations, the Civil Revision Petition stands disposed of.
