THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6279 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.2 and 3 in the event of their arrest in Crime No.341 of 2021 on the file of Station House Officer, Sangareddy Rural Police Station, Sangareddy District registered for the offence punishable under Section 306 of Indian Penal Code. 2.

Heard learned counsel for petitioner/Accused Nos.2 and 3 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that the 1st petitioner is the mother-in-law and 2nd petitioner is the village elder. The marriage of Accused No.1 who is the wife of the deceased was performed and unable to bear the harassment of his wife and his mother-in-law, the Accused No.1's husband committed suicide by jumping into river.

Learned counsel for the petitioner submits that the allegations are against the wife who is Accused No.1 and she was already arrested and released on bail. He further submits that except stating that these petitioners have helped Accused No.1 there is no other specific allegations against these petitioners and prayed for grant of anticipatory bail.

Learned Assistant Public Prosecutor opposes the bail application.

As seen from the allegations, the deceased vexed with the harassment of the Accused No.1 is alleged to have committed suicide. However, these petitioners who are mother-in-law and village elder can be granted the relief of anticipatory bail for the reason of there being any specific overtacts attributed to these petitioners for abetting suicide.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 and 3 shall be enlarged on bail in the event of their arrest subject to the following conditions:

i) The petitioners/Accused Nos.2 and 3 are directed to surrender before the Station House Officer, Sangareddy Rural Police Station, Sangareddy District within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.2 and 3 shall appear before the concerned Station House Officer on every Monday between 10.00 AM and 01.00 PM for the period of four (08) weeks. iii) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 8.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
