THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8068 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.4 and 5 seeking bail in the event of their arrest in connection with Crime No.34 of 2023 on the file of Mailardevpally Police Station, Cyberabad, registered for the offences punishable under Sections 302 and 307 r/w. 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The incident happened on account of fight between the family members in relation to a house property. It is alleged that on 12.01.2023, in the evening at about 5'o clock A-1 to A-3, A-6 and A-7 along with these petitioners have entered the house property and altercation ensured in which it is alleged that all the accused A-1 to A-7 assaulted the deceased. The deceased is the brother of these petitioners. As seen from the complaint, the deceased was attacked with iron rods inflicting injuries on both de-facto complainant and the deceased. However, these petitioners who are women were present and mentioned in the
complaint, but no specific over tacts were attributed to these petitioners.

Keeping in view that the 1st petitioner is mother of four children and the 2nd petitioner is aged about 18 years and is a student, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners, subject to the following conditions:
1) The petitioners/Accused Nos.4 and 5 are directed to surrender before the Station House Officer, Mailardevpally Police Station, Cyberabad, on 01.09.2023. On such surrender, the said Station House Officer shall release the petitioners/Accused Nos.4 and 5 on bail, on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, petitioners/Accused Nos.4 and 5 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday and Wednesday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.
3) The petitioners/Accused Nos.4 and 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
