THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.19604 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise. The intimation given to the petitioner herein, by the Deputy Commissioner, Prohibition & Excise, Siricilla-second respondent herein, vide Cr.No.362/2017/P&E/A1, dated 26.04.2018, that the auto bearing No.AP 15 TC 3084 has already been confiscated to the Government on 05.01.2018, is under challenge in the present Writ Petition. Unless the petitioner herein assails the confiscation order and comes out successfully, he is not entitled for any relief from this Court, under Article 226 of the Constitution of India.

Accordingly, the Writ Petition is dismissed. However, it is open for the petitioner herein to assail the confiscation order before the appropriate forum as per law. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
