HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.22704 of 2019 ORDER:
This writ petition is filed by the petitioner to declare the action of respondent Nos.3 and 4 in calling the petitioner to Godavarikhani I-Town Police Station and harassing him physically and mentally by depriving his personal liberty and interfering with his marital life, as arbitrary and illegal.
It is the case of the petitioner that he married to one Samina @ Raveena and the respondent police authorities are interfering with his marital life at the behest of unofficial respondent Nos.5 and 6, who are parents of his wife - Samina @ Raveena. Upon the notice issued by this Court on 18.10.2019, the learned Assistant Government Pleader for Home has obtained written instructions dt.23.10.2019 and submits that one Raveena had made a complaint dt.03.07.2019 to the Commissioner of Police, Ramagundam Commissionerate, stating that herself and the petitioner are childhood friends and taking advantage of her friendship and obtaining copies of her certificates, the petitioner has created a fake Marriage Certificate showing the said complainant married the petitioner.
Further, a bare perusal of the complaint would also reveal that on failure to accede to his demand, the petitioner threatened the complainant to kill her parents and thus, the complainant requested to investigate into the matter and take appropriate action against the petitioner.
TVK,J W.P.No.22704 of 2019 complaint made by Ms. Raveena, whom the petitioner claims to have married, has been forwarded to the SHO, Godavarikhani I-Town Police Station, to investigate into the matter and in that connection, respondent No.3 has called the petitioner to the Police Station as the matter relates to a matrimonial dispute by informing to the father of the petitioner. However, neither the petitioner nor his father appeared before respondent No.3 and in order to prevent respondent No.3 from enquiring into the matter, the present writ petition is filed and hence the same is liable to be dismissed. Having regard to the facts and circumstances stated above, I am of the view that no interference is called for by this Court at this stage, thereby preventing the police authorities from investigating into the matter in relation to the fake Marriage Certificate and photographs created by the petitioner with regard to the alleged marriage of the complainant - Samina @ Raveena with the petitioner.
Accordingly, this writ petition is dismissed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
