THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.22599 OF 2019 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

Petitioner claims that he is the owner of land to an extent of Acs.2.30 guntas in Survey No.388 of Sujathanagar Village, Kothagudem Revenue Division, Kothagudem Mandal, Bhadradri Kothagudem District. He entered into an agreement of sale with third parties and received sale consideration. Thereafter, when he along with the vendees approached for registration of the document, the Sub Registrar, Kothagudem, Bhadradri Kothagudem District, the 5th respondent, refused to receive the document without assigning any reason. Hence, this Writ Petition. 3.

Though it is asserted that the petitioner approached the 5th respondent in September 2019, no material is placed on record to show that the document was drafted and presented by paying the requisite stamp duty.

Learned counsel for the petitioner asserts that the subject property is not included in the list of prohibited properties. 5.

If that is so, there is no impediment to present the document for registration.

The Writ Petition is accordingly disposed of granting liberty to the petitioner to present the document by paying the requisite stamp duty and on receipt of the said document, the 5th respondent shall process the same. If the document cannot be

- 2 - registered, due reasons shall be assigned and communicated to the petitioner. If the document otherwise satisfies the formalities for registration, the same shall be processed. Pending miscellaneous petitions, if any, shall stand closed.
