Heard the learned counsel for the petitioner and learned Government Pleader for Revenue. Since the writ petition is disposed of without going into merits of the case, no notice is required to be issued to the fifth respondent. The petitioner questions the inaction of respondent Nos.1 to 4 in protecting the government property, situated in Sy.No.267/5, Adavipalem panchayat area, Kontheru Revenue Village, Elamanchili Mandal, West Godavari District, as illegal and arbitrary.
Though several contentions are urged by the learned counsel for the petitioner, he, however, restricts his prayer seeking a direction to dispose of representation made by the petitioner dated 18.08.2014 at the earliest.
Learned Government Pleader for Revenue would submit that, since the representation made is in the year 2014, it would be appropriate if a fresh representation is made by the petitioner, in which event, the authorities concerned would consider the same, in accordance with law, and pass orders thereupon at the earliest.
Learned Counsel for the petitioner would submit that a fresh representation would be filed before the third respondent - Tahsildar, Elamanchili.
In case such a representation is filed, the third respondent shall consider the same, and pass orders thereupon, in accordance with law at the earliest. The Writ Petition is, accordingly, disposed of. The Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
