THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.174 OF 2011 O R D E R :

Petitioners were granted D-Form patta for an extent of Ac.5.00 guntas each in survey No.424/2 and 424/3 of Inagaluru Village, Srikalahasti Mandal, Chittoor District on 26.01.1988 under separate proceedings. They were also issued Title Deed and Pattadar Pass Book under the provisions of the A.P. Rights in land and Pattadar Pass Books Act, 1971 (for short 'the Act') and their names were also mutated in the revenue records.

Petitioners contend that they have been cultivating the land ever since the said date; but at the instance of local political leaders, the respondents are trying to dispossess them from their lands, since the land value had appreciated as Bharat Heavy Electronics Limited had established a major industry nearby; and the respondents are not entitled to evict them from the lands assigned to them without following due process of law.

3. No counter affidavit has been filed by the respondents.

4. On 12.01.2011 while granting 'notice before admission' this Court directed maintenance of status quo with regard to possession of the land assigned to the petitioners.

The Government Pleader for Assignment appearing for respondents states that the respondents will follow due process of law, if they wish to dispossess the petitioners from the lands assigned to them.

6. In view of the said submissions, this Writ Petition is disposed of directing the respondents to follow the due process of law before

evicting the petitioners from the above mentioned lands assigned to them. There shall be no order as to costs.

7. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
