THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6524 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.4 for grant of anticipatory bail in the event of his arrest in connection with Crime No.127 of 2019 of Godavarikhani I Town Police Station, Peddapalli District, registered for the offences punishable under Sections 417, 420 and 109 read with 34 I.P.C.

Heard learned counsel for the petitioner/Accused No.4, and the learned Additional Public Prosecutor representing the respondent-State. Perused the record.

The allegation in the complaint would go to show that the daughter of de facto complainant fell in love with accused No.1, who promised to marry her and when she asked accused No.1 to marry her, he refused to marry her at the instigation of accused Nos.2 to 5, who are parents and brother of A.1. The specific allegation levelled against the present petitioner/accused No.4 is that he used to send messages to the victim and threatened her to marry him on the pretext that accused No.1, who is brother of the petitioner, will not marry her as he is having acquaintance with other ladies. It is further alleged that if she avoid the petitioner and marry anybody else, the petitioner will upload the photos taken by accused No.1 and the victim and damage her life. 4.

Learned counsel for the petitioner would submit that without there being any allegation against the present petitioner, a false

complaint is lodged against him; that no ingredients are attracted for the offences alleged against the petitioner under Sections 417, 420, 109 read with 34 I.P.C and hence, he prays to grant bail to the petitioner.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused No.4.

As per the contents of 161 Cr.P.C statement of victim as well as statements recorded under Section 164 Cr.P.C, there are specific allegations against the petitioner that he threatened the victim with dire consequences to marry him otherwise he would upload her photos, which were taken with accused No.1 and damage her life.

Having regard to the gravity of offence and the involvement of the petitioner in the commission of offence, I am not inclined to grant bail to the petitioner. Therefore, the prayer for anticipatory bail is rejected.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
