THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.13055 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioner/respondent seeking to quash the proceedings against the petitioner in D.V.C. No.39 of 2013 on the file of the Family Judge, Nizamabad, Telangana.

Heard the learned counsel for the petitioner/respondent and the learned Public Prosecutor and perused the material available on record. On a perusal of the record, this Court is of the view that truth or otherwise of the allegations made against the petitioner can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioner.

However, the trial Court is directed to dispose of D.V.C.No.39 of 2013 positively within a period of three months from the date of receipt of a copy of the order. The trial Court is also directed not to seek further extension of time for disposal of D.V.C.
