P. Sanyasi Rao v. The Eastern Power Distribution Company Of A.P. Limited
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.27482 OF 2003
ORDER
This writ petition is filed by the petitioner seeking absorption of his services in terms of B.P.Ms.No.36, dated 18.5.1997.
Though this Writ Petition was admitted on 04.01.2004, no interim order was granted by this Court.
Learned counsel appearing for the petitioner contends that the petitioner worked as Village Electricity Worker in Mindi Panchayat, Gajuwaka, during the period 1988-90 and that for the past two and half decades, he is not working. Learned Standing Counsel appearing for the respondents contends that B.P.Ms.No.36 was withdrawn in the year 2006 and hence, the question of considering the case of the petitioner at this point of time does not arise. Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that B.P.Ms.No.36 was withdrawn by the respondents way back in 2006, based on which the petitioner is seeking absorption, and that the petitioner, who worked as Village Electricity Worker, is not continuing in service for more than
two and half decades. Therefore, at this length of time, the relief as sought for by the petitioner cannot be granted. There are no merits in the writ petition and the same is liable to be dismissed.
Accordingly, the Writ Petition is dismissed. No costs. Pending Miscellaneous Petitions, if any, shall also stand dismissed.
