HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8010 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Respondent under Section 482 Cr.P.C seeking to quash the order dated 22.07.2015 in Crl.M.P.No.507 of 2013 in M.C.No.2 of 2013 on the file of Judicial Magistrate of First Class, Railway Kodur, Kadapa District.

2) Heard and perused the material on record.

3) While upholding the order of maintenance, by moving the same, with a direction to deposit before the lower Court in pursuance of the order rather than payment to respondents 2 and 3 (petitioners in M.C.) by taking up the trial day to day within two months from the date of receipt of a copy of this order, as from 1st respondent agreement regarding the permanent alimony settlement for Rs.5.25 lakhs and payment out of it of Rs.3 lakhs is in dispute that is also has its bearing either on the entitlement or on the quantum, as the case may be and any expression at this stage in this application since prejudice to the rights of the parties this Court left it open.

4) With the above direction, this Criminal Petition is disposed of.

5) Miscellaneous petitions pending, if any, in the Criminal Petition shall stand closed.
