HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18517 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the proceedings in C.C.No.1302/KVL/75, dated 18.05.2016, issued by the 4th respondent as arbitrary and illegal and consequently, set aside the same.
2. Heard both sides.
3. Admittedly against the impugned order, dated 18.05.2016, passed by the Tahsildar, Kavali, an appeal lies under Section 10 of the A.P. Land Encroachment Act, 1905 (for short, 'the Act') and when the same is pointed out, learned counsel for petitioner seeks permission to withdraw the petition with a liberty to avail the alternative remedy.
4. Permission as sought for is accorded.
5. Accordingly, the Writ Petition is dismissed as withdrawn with a liberty to the petitioner to avail the alternative remedy by filing appeal under Section 10 of the Act. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
