THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8781 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents herein in non-payment of petitioners' husband retirement benefits as illegal, arbitrary and contrary to law and set-aside the same and further direct the respondents herein to pay petitioner's husband retirement benefits forthwith with 18% interest per annum w.e.f. date of termination to till payment of retirement benefits."

Heard Sri P. Govinda Rajulu, learned counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for respondents.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 1104-2011 to 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 3rd respondent to pass appropriate orders on the representation, dated 11-04-2011, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of,

without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 11-04-2011 said to have been submitted by the petitioner herein, in accordance with law, within a period of six

(6) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
