THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.10249 OF 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ order or direction more particularly, one in the nature of Writ of Mandamus, declaring the notices issued by the respondent no.2 vide no.01/TPS/W.No.1/CIR-18/NZ/GHMC/17 dated 04.03.2017 and no.
01/TPS/W.No.1/CIR18/NZ/GHMC/17 dated 14.03.2017 are illegal, arbitrary, violative of principles of natural justice and consequently set aside the said notices and further direct the respondents not to demolish the existing compound wall or any structures of the petitioners in respect of premises bearing no.1-10-27/34/A/39, vide plot no.39 situated at Prakash nagar (new extension colony) Begumpet,Secunderabad."

It is the case of the petitioners that since their neighbours have already constructed compound walls to their respective lands, only with an intention to protect the subject land, they have constructed a compound wall long back and at present, they are not proceeding further with any construction activity in the said land.

Learned counsel for the petitioners submitted that the petitioners will make an application before the concerned authorities for regularization of the compound wall already constructed in the subject land.

Considering the facts and circumstances of the case and taking into consideration the submission of the learned counsel for the petitioners, the respondents are directed not to take any coercive steps against the compound wall of the petitioners in the subject land and the petitioners are directed to make an application before the concerned authorities for regularization of the compound wall, which was already constructed long back, and on such application being made, the authorities shall consider the same and pass appropriate orders in accordance with law. 5.
With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
