The present writ petition is filed to declare the action of respondent Nos.3 and 4 in calling the petitioners to the police station and threatening petitioner No.1 to leave petitioner No.2, who is the paternal uncle of petitioner No.1, and to join respondent No.5, against her will and wish, as illegal and arbitrary.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 01.11.2019, which is placed on record of this Court, would submit that respondent No.5 herein lodged a complaint before the fourth respondent on 25.07.2019 stating that she is having a daughter, by name, V.Srivani, who is petitioner No.1 herein, and she was four years old when her brother-in-law took her away from her house and that when she sought to call petitioner No.1 to come to post office in order to withdraw the fixed deposit amount made in her name, he is refusing to permit her daughter from coming to the post office for such purpose and it is alleged that petitioner No.2 with ill intention in his mind is holding back petitioner No.1.

Learned AGP would further submit that on receipt of the compliant, a General Diary entry was made and the matter was enquired into and called both the parties for counselling. During counselling before respondent No.4, petitioner No.1 stated that her uncle is looking after her well and taking care of her studies and that he would withdraw the fixed deposit amount at the time of her marriage.

that except doing counselling acting on the complaint of respondent No.5, the respondent authorities never threatened petitioner No.1 to leave petitioner No.2 and to join respondent No.5.

In the light of the submissions made by the learned AGP on behalf of the respondent authorities explaining their stand, this Court is of the view that the apprehension of the petitioners does not merit consideration and no further orders are required to be passed in the writ petition. 5.
