THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Writ Petition No.2401 of 2009 Dated 14th July, 2015 Between:
Ashraf Begum
...Petitioner
And The Government of India, rep.by its Secretary, Telephone Department, New Delhi and others
...Respondents
Counsel for the petitioner: Ms.T.Padmaja for Sri S.M.Subhani Counsel for respondent Nos.1 to 4: Ms.J.K.Anitha for Sri B.Devanand Counsel for respondent Nos.5 to 7: Sri M.Venkat Ram Reddy The Court made the following:
ORDER:
This writ petition is filed for the following substantive relief: "...to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents in not releasing the family pension in favour of the Petitioner as per the application submitted by her in the month of August, 2007 as being illegal, arbitrary, unconstitutional."
At the hearing, Ms.T.Padmaja, learned counsel, representing Sri S.M.Subhani, learned counsel for the petitioner, submitted that after filing of the writ petition, family pension has been paid to her client and that therefore, the writ petition has become infructuous. Though this submission of the learned counsel is disputed by Sri M.Venkat Ram Reddy, learned counsel for respondent Nos.5 to 7, considering the fact that the petitioner is not intending to pursue the
writ petition, it is unnecessary for this Court to delve into the reasons for which the writ petition has become infructuous. In the light of the submission of the learned counsel for the petitioner that the writ petition has become infructuous, the same is dismissed as such.
As a sequel to dismissal of the writ petition, interim order, dated 18.02.2009, shall stand vacated and W.P.M.P.Nos.3062/09, 31625/12 and 10663/13 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 14th July, 2015 VGB
