HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Appeal No.1085 of 2015 PC:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant does not press this appeal and states that the appellant may be allowed to raise an issue of locus of respondent No.1, who is impleaded as a party in the instant proceedings.

We have perused the order impugned in the present appeal. Keeping that in view, we observe that it is open for the appellant to contend before the learned Single Judge, at the stage of hearing of the writ petition, that respondent No.1 has no locus insofar as these proceedings are concerned. If any such contention is raised, we hope and trust that the learned Single Judge shall deal with the same in proper perspective.

The writ appeal is disposed of as not pressed. Consequently, pending miscellaneous applications shall also stand closed.
