HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.11696 of 2015 O R D E R :
The petitioner, who is accused No.1 in C.C. No.90 of 2014 on the file of the court of XV Additional Chief Metropolitan Magistrate, Hyderabad, for the alleged offences punishable under Sections 498A, 406 I.P.C. and Sections 4 & 6 of Dowry Prohibition Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The charge-sheet has already been filed in this case and the trial Court has taken cognisance of the said charge-sheet. N.B.W. is pending against the petitioner-accused No.1.
Considering the facts and circumstances of the case, the petitioner-accused is directed to surrender before the Magistrate concerned and file petition to recall N.B.W. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused is directed to report before the trial Court on all hearing days.
