THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CONTEMPT CASE No.1335 OF 2018 ORDER:

This Contempt Case, under Sections 10 to 12 of the Contempt of Courts Act, 1971, is filed complaining wilful disobedience of the orders of this Court, dated 20.04.2018, in W.P.No.13214 of 2018. 2.

I have heard the submissions of Sri P. Nagendra Reddy, learned counsel for the petitioner, and of the learned Government Pleader for Home, appearing for the respondent. I have perused the material record. 3.

The operative portion of the afore-stated order of this Court in the above said Writ Petition reads as under:

"Recording the submissions, the Writ Petition is disposed of reserving liberty to the petitioner to submit a detailed representation as sought for to the police officer concerned for consideration and disposal of the same in accordance with the procedure established by law during the course of investigation into the afore-stated crime."

The case and the submissions of the petitioner are that despite the orders of this Court, the respondent failed to consider the representation of the petitioner filed along with the affidavits of the witnesses; and, that after the Contempt Case is filed, a counter has been filed stating that the representation of the petitioner is considered and that a Final Report has already been filed stating that no case has been made out for filing charge sheet against accused nos.2 and 3.

In that view of the matter, a request is made by the learned counsel for petitioner to close the Contempt Case reserving liberty to the petitioner to approach the trial Court either with a request to order further investigation or a protest application & seek appropriate remedies, which the law permits.

Learned Government Pleader for Home submits that since Final Report is filed, no cause survives for adjudication in the Contempt Case. 7.

Recording the submissions, the Contempt Case is closed reserving liberty to the petitioner as sought for.

There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Contempt Case shall stand closed.
