THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13137 of 2005 ORDER:
Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. This Writ Petition was filed challenging the action of the respondents in trying to demolish the building bearing door Nos.12-131 to 136 in Survey No.148, Main Road, Rajam, Srikakulam District, without following due process of law. A counter affidavit is filed by the fourth respondent stating that the fourth respondent has not initiated any action to remove the encroachment made by the petitioner and as and when the fourth respondent proposes to widen the road portion by removing the encroachment of the petitioner, the same would be removed as per law by giving due notice to the petitioner after conducting survey.
In view of the statement made by the fourth respondent in the counter affidavit, the learned Counsel for the petitioner submits that by recording the said statement in the counter affidavit the Writ Petition can be closed.
The Writ Petition is, accordingly, closed.
