THE HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.2797 of 2015 ORDER:
This Civil Revision Petition, under Article 227 of the Constitution of India, is filed against the order, dated 10.06.2015, passed in I.A.No.7 of 2015 in R.C.No.356 of 2012 on the file of the IV-Additional Rent Controller at Hyderabad.
The aforesaid R.C was filed by the respondents herein, for eviction of the petitioners herein from the petition schedule property. In the said R.C, the present application in I.A.No.7 of 2015 is filed by the petitioners herein, who are respondents in the R.C, seeking to call for the records pertaining to application dated 17.01.2015 filed by petitioner No.1 in the R.C., from the Tahsildar office, Amberpet, Hyderabad, on the ground that the same was filed seeking regularization of petition schedule property and as such it is a necessary document to prove that the petitioners in the R.C have no title over the petition schedule property.
It is the case of the petitioners herein that the respondents have no title over the property and having filed the R.C in the year 2012 claiming ownership over the property, they have applied for regularization of the property in the year 2015, which itself shows that they made a false claim and, in order to prove the same, it is necessary to call for records pertaining to the regularization application made by them.
If at all the respondents herein have filed an application seeking regularization, it is open for the petitioners to obtain certified copy of the same if such document is necessary to prove their claim, but there is no reason to call for the records from the Tahsildar office as prayed for in the present I.A. In any event, the Rent Controller cannot decide title disputes in R.C proceedings. In that view of the matter,
the revision is devoid of merits.
Accordingly, the Civil Revision Petition is dismissed. No order as to costs.
As a sequel, the pending miscellaneous petitions, if any, shall stand closed.
