THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.108 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 16.11.2015 passed by this Court in W.P.No.36100 of 2015. By the said order, this Court directed the police authorities concerned to act upon the complaint dated 16.07.2015 filed by the petitioner in terms of the law laid down by the Supreme Court in LALITA KUMARI Vs. GOVERNMENT OF UTTAR [1] PRADESH .

It is now stated by the learned Assistant Government Pleader that upon consideration of the petitioner's complaint, intimation was given to the petitioner as to why her complaint did not warrant action under penal laws. A copy of the notice given to the petitioner/complainant in this regard is also placed before this Court indicating that the petitioner received it on 17.06.2016. That being so, this Court finds no disobedience, much less willful disobedience, to the order passed in W.P.No.36100 of 2015 warranting exercise of contempt jurisdiction.

The contempt case is accordingly closed. It shall be open to the petitioner to avail appropriate remedies in accordance with law. No order as to costs.
