Ramachandra Rao) Sri Nazir Ahmed Khan, learned counsel for the appellant, seeks permission of this Court to withdraw the appeal with liberty to file an application before the XI Additional Chief Judge, City Civil Court, Hyderabad, to vacate the order, dated 01.10.2019 passed in I.A. No.999 of 2019 in O.S. No.587 of 2018 on the file of the said Court.

2. Permission is granted.

3. Accordingly, the Civil Miscellaneous Appeal is dismissed as withdrawn. It is made clear that if any such application is filed by the appellant, the Court below shall decide the same within a period of two (2) weeks, after hearing both sides. No order as to costs.
