HON'BLE SRI JUSTICE R. KANTHA RAO ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the respondents in orally asking the petitioner not to attend the institution as illegal, arbitrary and violation of principles of natural justice and Articles 14, 16 and 21 of the Constitution of India.

2. Heard the leaned counsel appearing for the petitioner and the learned Counsel appearing for the respondents.

3. According to the petitioner, he established a Smartha Veda Pathasala under Jagadguru Arsha Vidyapeetham in Vijayawada on 14.06.2002 with the aim of imparting coaching in Yajurveda Smartham. There are more than 20 students undergoing coaching in the said Pathasala and on his request, the Veda Pathasala was taken over by the Endowments Department. After taking over the institution, the petitioner was treated as Principal/Pradhana Acharya of the Veda Pathasala. According to the petitioner, initially he was paid consolidated amount of Rs.8,000/- as salary, but after taking over the institution, his salary was reduced to Rs.4,000/-. Therefore, he made several representations and ultimately, the Commissioner, Endowments Department enhanced the salary from Rs.4,000/- to Rs.6,000/-. While so, it is said that suddenly, the second respondent without any sufficient reasons, high handedly informed the petitioner orally not to attend the institution. Thereafter, the petitioner approached the commissioner ventilating his grievance through representation, dated 28.04.2011.

Considering the submissions made by the learned counsel appearing for the petitioner, the writ petition is disposed of directing the first respondent/Commissioner, Endowments Department to dispose of the representation dated 28.04.2011 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. There

shall be no order as to costs. Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
