THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13578 of 2016 ORDER :
The present Criminal petition is filed seeking relaxation of the conditions imposed in Crl.M.P.No.913 of 2016 in Crime No.35 of 2016 on the file of the IV Additional Sessions Judge, Kadapa. By an order dated 14.07.2016 passed in Crl.M.P.No.913 of 2016 in Crime No.35 of 2016, the IV Additional Sessions Judge, Kadapa, while releasing the petitioner on bail, directed the petitioner to execute a self bond for Rs.20,000/ - with two sureties in a like sum each to the satisfaction of the Judicial Magistrate of First Class, Badvel.
Learned counsel for the petitioner submits that the petitioner and his family members are eking out their livelihood by doing beedi works and as the petitioner is resident of Karnataka State, is unable to produce two sureties to a tune of Rs.20,000/ -. He further submits that though the bail was granted on 14.07.2016 but the petitioner could not get himself released till date, hence requested to relax the said conditions.
Learned Public Prosecutor opposed the application contending that the petitioner is resident of Karnataka State and it is difficult to secure his presence without local sureties.
Having regard to the facts and circumstances of the case and since the petitioner could not avail the relief though granted long
back, the condition is modified directing the petitioner to execute a bond for Rs.10,000/ - with two sureties for a like sum each, out of which one surety must be a local surety and another surety must be from the native place of the petitioner. The learned Magistrate shall verify the antecedents before accepting the sureties. All other conditions shall remain un-altered.
With the above modification, the Criminal Petition is disposed of.
