THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6305 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.513 of 2022 on the file of Malkajgiri Police Station, Rachakonda, Hyderabad, registered for the offences punishable under Section 366 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation against the petitioner is that he is the cousin of victim and on 27.05.2022, the petitioner/accused took the victim girl to Kattamaisamma temple and married her. Thereafter they went to Vemulavada, Bansuvada and Yadagirigutta temples and stayed there.

Learned Counsel for the petitioner submits that the victim is aged above 18 years, however, the police have stated that she is 17 years without producing any evidence.

Learned Assistant Public Prosecutor submits that six witnesses have already been examined.

As seen from the circumstances, both the victim and petitioner travelled to different places and stayed in rented premises at those places. As seen from the allegations leveled the victim had travelled along with the petitioner who is her cousin and stayed at different places. The petitioner is in jail since 04/06/2022.

In the said circumstances, petitioner/accused can be granted bail.

Accordingly, the Criminal is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of I Additional District and Sessions Judge-cum-Metropolitan Sessions Judge, Cyberabad at Medchal-Malkajgiri District at Malkajgiri. ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
