THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8118 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.459 of on the file of Ramachandrapuram Police Station, Cyberabad, registered for the offences under Sections 363 of IPC and Section 12 of the POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The 2nd respondent herein lodged a complaint stating that his elder daughter, who is studying Intermediate left for college and did not return home. He enquired and found out that this petitioner had taken his daughter in a car. Accordingly, lodged a complaint. The Police having received the complaint registered the same and arrested the petitioner. In the remand report, it is

mentioned that the petitioner and the daughter of the 2nd respondent who is the victim were in love for the past four years and there was a proposal for marriage. 4.

Keeping in view that there was earlier relation and there is no allegation of any kind of physical assault, this Court deems it appropriate to grant the relief of regular bail to this petitioner, subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties, for a like sum each to the satisfaction of Special Judicial Magistrate of First Class (Prohibition and Excise Offences) Court, Sangareddy.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Tuesday for a period of four weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused shall not in any manner try to contact either the victim girl or her relatives.

(iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
