THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.2601 of 1999 JUDGMENT:

On 19.02.2018, learned counsel for the appellants submitted that he had written registered letter to the appellants and that there was no response from them and that he has already returned the case records to the party concerned. Therefore, the Appeal Suit was directed to be listed today under the caption "for dismissal" by printing the names of the appellants. Today, there is no representation for the appellants. The appellants are called absent. 2.

Since the learned counsel stated that he has already addressed a registered letter to the appellants, this Court is of the considered view that there is no need to issue notices to the appellants through Court. The above conduct of the appellants indicates that the appellants are not interested in prosecuting the Appeal Suit. 3.

In the result, the Appeal Suit is dismissed for default. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
