HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24678 of 2010 ORDER:

This writ petition was filed challenging the action of respondents 1 to 5 in allowing respondents 6 to 8 to stay in the hospital of their choice without there being any reference by a panel of doctors with regard to their alleged ill-health. 2.
Respondents 6 to 8 were remand prisoners in Crime Nos.76 and 77 of 2010 on the file of Chapadu Police Station, Kadapa District. They were allowed to stay in the hospital from 04.08.2010. It is stated that in spite of repeated representations to the official respondents 1 to 5 with regard to the false claim made by respondents 6 to 8, no action was taken so far.

Though this Court admitted the writ petition on 08.08.2011 and called for a report in the matter, in view of lapse of time, this Court is not inclined to enquire into the matter, which has become an academic issue. Now, it is submitted that respondents 6 to 8 are not in the hospital and they are facing trial in the criminal cases.

In the aforesaid circumstances, this Writ Petition is closed. No order as to costs.
