THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.19623 of 2018 ORDER:

Until and unless, the proceedings under which the land is resumed are challenged and set aside, by referring to the information given under Right to Information Act, it cannot be concluded that the reference made in the endorsement is non-existing proceeding.

By granting liberty to petitioners to challenge the endorsement as well as the alleged resumption proceedings, the writ petition is dismissed.

In the event, an appeal is filed before the Revenue Divisional Officer, as rightly contended by Mr.Aswartha Narayana that the affect of un-communicated order or a void ab initio etc., can certainly be considered by the Revenue Divisional Officer and a comprehensive order is passed on the endorsement as well as resumption proceedings. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
