THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8203 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/A1 to A4 and A6 seeking anticipatory bail in the event of their arrest in connection with Crime No.73 of 2023 on the file of Aize Police Station, Jogulamba Gadwal District, registered for the offence punishable under Section 324 read with 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioners/A1 to A4 and A6, learned Assistant Public Prosecutor for the respondent-State and perused the record.

It is alleged that the petitioners attacked the de facto complainant after picking up quarrel with him. The said incident took place when the de facto complainant was in his fields. It is alleged that the petitioners beat the de facto complainant on his head and left hand and as such, he received bleeding injury. All the petitioners are responsible for beating the de facto complainant indiscriminately. 4.

As seen from the remand report, the de facto complainant received laceration on the head and abrasion on the knee. It is admitted fact that the petitioners and the de facto complainant belong to one family and there are land disputes between them. 5.

Keeping in view the two injuries received by the de facto complainant and that the disputes are within the respective families,

the petitioners/A1 to A4 and A6 can be granted the relief of anticipatory bail, subject to the following conditions:

1) The petitioners/A1 to A4 and A6 are directed to surrender before the Station House Officer, Aize Police Station, Jogulamba Gadwal District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A1 to A4 and A6 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A1 to A4 and A6 shall appear before the concerned Station House Officer, on every Monday, for a period of eight(8) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.

3) The petitioners/A1 to A4 and A6 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
