Gadiparthi Rajendra Prasad v. Savada Chandra Mohan
HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRL.R.C.M.P.No.1573 of 2017 IN/AND CRIMINAL REVISION CASE No.972 of 2017 COMMON ORDER :
Crl.R.C.M.P.No.1573 of 2017 is filed under Section 5 of the Limitation Act to condone delay of 26 days in preferring the revision against the order, dated 18.11.2016, passed by the Metropolitan Sessions Judge, Vijayawada, in Crl.M.P.No.1002 of 2016 in Crl.R.P.No.88 of 2016 in C.C.No.206 of 2015.
2.
The specific reason assigned by the petitioner is that the counsel after obtaining certified copies of the documents to prefer revision tried to contact the petitioner on mobile as the same could not contact him as he was away from Vijayawada being a breadwinner of the family. Therefore, he had no information to file a revision against the order. But the said fact is not substantiated by any material and counsel for the petitioner conveniently avoided even to represent the matter, the reason best known to him.
3.
Accordingly, Crl.R.C.M.P.No.1573 of 2017 is dismissed. Consequently, Crl.R.C.No.972 of 2017 is rejected. 4.
Miscellaneous petitions pending, if any, shall stand closed. _________________________________ M. SATYANARAYANA MURTHY, J 2nd August 2017.
