THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21046 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to direct respondents 3 to 5 from interfering with the internal affairs of the Annapoorna Market Committee and calling upon for closure of the opening ahead provided on the western side 25 shop owners for their ingress and aggress APC Market to enable them reaching trunk road, as illegal and arbitrary.
Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer, seeking a direction to the respondents not to interfere with the internal affairs of Petitioner-Market Committee.
Learned Assistant Government Pleader, on instructions, denies the allegations made in the affidavit filed in support of the Writ Petition and submits that the allegation of respondents-Police interfering with the affairs of the Committee is incorrect. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police not to interfere with the affairs of the Petitioner-Market Committee except by following the procedure established under law.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
