ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.1 to 3 in seizing the stocks of red gram under panchanama, dated 22.07.2009, as illegal and arbitrary. The petitioners sought for a consequential direction to
respondent No.1 to forbear from proceeding with E.C.Act Case No.150/2009-S7. At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that during the pendency of this writ petition, proceedings under Section 6-A of the Essential Commodities Act, 1955 were concluded and final order was passed on 08.09.2010 confiscating 5% of the seized stock.
In the light of this subsequent development, the cause in the writ petition does not survive for adjudication. Accordingly, the writ petition is disposed of as infructuous.
As a sequel to disposal of the writ petition, W.P.M.P.Nos.22940 & 22941 of 2009 shall stand disposed of as infructuous.
