THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.849 OF 2016 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in CRIME No.65 of 2015 of Kota Police Station, SPSR Nellore District, registered for the offences under Sections 420 and 506 IPC.

Heard and perused the records.

Learned counsel for the petitioner submits that Court below granted anticipatory bail to the petitioner herein. Subsequently, the petitioner/accused approached this Court for quashing the proceedings, in which this Court granted stay of arrest. He further submits that without knowing this, the prosecution filed an application for arrest of the petitioner and that the Court below issued Non Bailable Warrants (NBWs) against the petitioner. Hence, there is an apprehension of arrest.

Considering the facts and circumstances, the operation of NBWs issued against the petitioner/accused is hereby suspended till passing of orders by the Court below in Crl.P.No.5503 of 2015.
