THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.19784 of 2018 ORDER:

The petitioner challenges the notice issued by respondent No.5 calling upon the petitioner to attend the enquiry scheduled at 11-00 A.M on 29.05.2018 at Sub-Collector's Office, Tirupati, as illegal and without jurisdiction.

The issue arises under the A.P. Agricultural Land Conversion to Non-Agricultural Land Act, 2006 (for short 'the Act'). This Court is of the view that the notice is issued to verify whether the petitioner has discharged the obligation under the Act, 2006 or not. Though Mr Chinnapa Reddy raises a few jurisdictional objections by referring to G.O.Ms.No.145 dated 28.03.2006, this Court is of the view that all the issues and various circumstances including the time of conversion etc., can be gone into by the competent authority.

Therefore, the writ prayer is not entertained. However, to meet the ends of justice, the writ petition is disposed of by this order:

"Respondent No.5 considers and disposes of the enquiry pending in File No.ROC.J/731/2018 within fifteen (15) days from the date of receipt of

copy of this order and communicate the order to petitioner."

Writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
