ORDER

This writ petition is filed seeking a writ of certiorari calling for the records in connection with I.D.No.182 of 1997 on the file of the Industrial Tribunal-cum-Labour Court, Anantapur, dated 10.07.2001. 2.

When the matter came up for hearing, learned counsel for the petitioner submits that the petitioner has retired from service and therefore, the cause in the writ petition does not survive for adjudication.

The material on record shows that the order of removal passed by the second respondent Corporation was modified by the Labour Court directing the Corporation to reinstate the petitioner into service with other terminal benefits, but without back-wages and also directed to defer three annual increments without cumulative effect vide order dated 10.07.2001 in I.D.No.182 of 1997. The Labour Court has exercised power under Section 11-A of the Industrial Disputes Act, on proportionality theory and rightly passed the award and there are no merits in the present writ petition. 4.

The Writ Petition is accordingly dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
