THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19244 OF 2016 ORDER:
Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development and learned Government Pleader for Finance and Planning. With consent of both the counsel, the present writ petition is disposed of at the admission stage. 2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not paying the final bill amount to the petitioner in respect of the works entrusted to him vide Agreement No.T3/TFC(ZP)/10-11, dated 08.11.2010 of the 3rd respondent as arbitrary and illegal and consequently, to direct the respondents to pay the final bill amount together with interest thereon from the date of completion of the said works till disbursement, forthwith.
3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation dated 16.05.2016 made by the petitioner at the earliest.
5. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing the respondents to consider the representation dated 16.05.2016 made by the petitioner for release for payment within a period of three (03) weeks from the date of receipt of a copy of this order, in accordance with law.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
