THE HON'BLE SRI JUSTICE K.C. BHANU AND THE HON'BLE MRS JUSTICE ANIS WRIT APPEAL No.532 OF 2015 JUDGMENT: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Appeal is filed aggrieved by the order, dated 19.6.2015, in Writ Petition No.17806 of 2015 of a learned Single Judge of this Court.

2. W.P.No.17806 of 2015 was filed by the appellant herein/writ petitioner seeking to issue a writ of Mandamus declaring the action of the respondents in not receiving his application for the post of Junior Mazdoor only on the ground that his name must be sponsored from respondent No.2 as illegal and arbitrary, and consequently, to direct respondent No.1 to receive his application and to allow him to participate in the selection process including test and interview to the said post.

The same was dismissed on the ground that the appellant/writ petitioner is over aged.

3. Heard both sides.

4. It is not in dispute before this Court that though the appellant's name was sponsored by the Employment Exchange and he appeared before the Selection Committee for the first notification issued on 07.05.2014, he was not selected. In the second notification, dated 18.5.2015, which was issued for the remaining vacancies of 25 posts of Junior Mazdoors, the maximum age limit for the land oustees under Open Category is 50 years as on 30.06.2015. The appellant/writ petitioner crossed 50 years by 30.06.2015, which is the cut off date for reckoning the maximum age limit. As he crossed 50 years, he is not eligible for the said post. Precisely for that reason, the learned Single Judge rightly dismissed the Writ Petition and that order needs no

interference of this Court. The Writ Appeal is devoid of merit and is liable to be dismissed.

5. The Writ Appeal is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Appeal shall stand closed.
