NO: 1 OF 2018 Petition under section 482 of cr.P.c praying that in the circumstances stated in the Memorandum of Grounds of criminal Petition,the High court may be pleased to suspend the order passed in Crl.M.P.No. 179512016 in MC No' 268t2016, dt.31-03-2018, on the file of Hon'ble Additional Metropolitan sessions Judge for the trial of the JHCBBC-Cum-Additional Family court, Hyderabad, granling interim maintenance in favour of the Respondents 2 and 3.

This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri ARUN KUMAR DODDLA, Advocate for the Petitioner being not present and the Public Prosecutor (IG/AP) on behalf of the Respondent No.1 and Sri.P. HARI PRASAD REDDY for the Respondent No.2 and 3.

The Court made the following: ORDER

THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6O67 of 2O18 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-husband seeking to quash the impugned order, dated 3I.O3.2O18 passed in Crl.M.P.No.1795 of 2016 in M.C.No.268 of 2016 by the Additional Metropolitan Sessions Judge for the Trial of JHCBBC-cum-Additional Family Court, Hyderabad, whereby the Court below was pleased to grant interim maintenance in favour of the respondent Nos.2 and 3 i.e., wife and daughter of the petitioner-husband, at the rate of Rs.7,OOO/- and Rs.2,000/ - per month respectively, from the date of petition i.e., 23.05.2016 till the disposal of the main M.C. 2.

None appears for the petitioner.

As seen from the record, no interim orders are passed suspending the impugned order, dated 31.O3.2O18. Since interim maintenance is questioned, at this length of time, it is unlikely that the subject M.C. i1 still pending. Further, no proof is frled by the petitioner with regard to the payment of Rs.2,5O,0OO/- as directed by this Court. Therefore, this Court do not find any reason to keep the criminal petition pending. 4.

Accordingly, the Criminal Petition is disposed of granting liber$r to the petitioner to approach this Court, if cause survives.
