THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION Nos.6989 & 8072 of 2016 COMMON ORDER:
These two petitions under Section 482 Cr.P.C. are filed by the petitioners/A.5 & A.6 seeking to quash the proceedings in F.I.R.No.71 of 2016 of Banaganapalli Police Station, Kurnool District, registered for the offences punishable under Section 498-A, 304-B IPC, r/w.34 IPC and under Section 3 and 4 of Dowry Prohibition Act against A.5 and under Sections 498-A, 306 r/w.511, r/w.34 IPC and under Section 3 and 4 of Dowry Prohibition Act against A.6.
2. Heard learned counsel for the petitioners/A.5 & A.6 and learned Additional Public Prosecutor representing the State.
3. A perusal of the complaint, material on record and dying declaration did not prima-facie show that it is a fit case to quash the proceedings at the threshold by scuttling further investigation. The matter is at the stage of investigation and needs to be investigated to ascertain the truth or otherwise of the allegations made in the complaint. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the police concerned are directed to proceed with the investigation without arresting the petitioners/A.5 and A.6. The petitioners/A.5 and A.6 are directed to appear before the investigating agency, as and when required and cooperate with the investigating agency.
4. With the above direction, the Criminal Petitions are disposed of.
5. Miscellaneous petitions, if any, pending in these criminal petitions shall stand closed.
