The writ petition is filed to declare the action of respondents 3 and 4 in resorting to assign/allot the petitioners' house site Plot Nos.23, 63, 65, 47, 162, 330, 48, 50, 49, 179 and 180 in Survey Nos.51 and 280 of Noonepalli village, Nandyal mandal, Kurnool District, assigned by respondent No.4Tahsildar vide proceedings in RDIS/490/08 dated 05.05.2008, RDIS/255/010 dated 06.05.2010 and RDIS/490/11 dated 04.11.2011, and same are subsisting, only by succumbing to political pressures in flagrant disregard to law, as being illegal and arbitrary, and consequently direct the respondents not to interfere with peaceful possession and enjoyment of the petitioners over the aforesaid plots.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader.

Counter affidavit is filed stating that since the petitioners were not found in the village, notices were affixed to the stick at the site and orders of resumption were passed.

Sri K. Rathangapani Reddy, learned counsel for the petitioners submits that the writ petition can be disposed of granting liberty to the petitioners to challenge the said proceedings.
