O R D E R

This writ petition is filed for the following relief: " To issue writ or direction preferably writ of mandamus, declaring the action of respondent No.4 in calling the petitioners to the police station Duvvada of Gajuwaka (M) Visakhapatnam District and keeping the vehicle bearing No. AP 31 DG 7473 i.e., K.T.M. 200 Duke BS -3 motor cycle in the police station without there being any crime registered against them, as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondent No.4 not to insist the petitioners to come to the police station i.e., Duvvada of Gajuwaka (M), Visakhapatnam and release the vehicle and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Duvvada Police Station, Visakahaptnam City, to the effect that the based on the report of the 5th respondent, a case in Crime No.180/ 2018, was registered under the head 'woman missing' and took up investigation. One Ravi is the suspect and the petitioners, who are his family members, were called to the police and they assured that their son Ravi, who is working at Vijayawada, would be produced before the 4th respondent. It is further stated that this respondent has not violated any rules or regulations and that the two wheeler of the petitioner was also not kept in their custody as alleged by the petitioners.

Learned counsel for the petitioner seriously disputing the above averments made in the written instructions, submits that after filing of the writ petition, the vehicle of the petitioner was released. He further submits that petitioners 3 and 4 are students and on the pretext of investigation, they are not being allowed even to attend interviews for jobs.

Learned Assistant Government Pleader, on instructions, denied that 4th respondent is indulging in the activities alleged by the petitioners. Having regard to the facts and circumstances of the case and the submissions of the learned counsel, the writ petition is disposed of directing the 4th respondent not to interfere with the personal liberty of the petitioners without following due process of law.
