THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2412 OF 2012 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondent in cancelling the parking lot lease allotted to the petitioner vide File No.Misc/EMC/HMDA/P.K.Park/10, dated 01.12.2010 and renewed vide Renewal Notice vide No.Misc/EMC/HMDA/P.K.Park/10, dated 09.11.2011, which is valid upto 30.11.2012, as arbitrary and illegal and consequently direct the respondent to continue the petitioner's lease till 30.11.2012 as renewed vide No.Misc/EMC/HMDA/P.K.Park/10, dated 09.11.2011 with all consequential benefits.

Heard and perused the material.

When the case was called on 23.01.2017, learned counsel for the petitioner was absent and there was no representation and as such, the case was directed to be listed under the caption 'for dismissal'. Today, i.e., 30.01.2017, though the case is listed under the caption 'for dismissal', learned counsel for the petitioner is absent and there is no representation. Hence, the writ petition is liable to be dismissed for default/ non-prosecution.

The writ petition is accordingly dismissed for default/ non-prosecution. Consequently, miscellaneous petitions, if any shall also stand dismissed.
