THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5742 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.91 of 2016 on the file of Maheshwaram Police Station, Cyberabad, Ranga Reddy District, registered for the offence punishable under Section 3(1)(x) of the SCs & STs (POA) Act. Heard and perused the material available on record. It is alleged that the 2nd respondent and her brother-in-law are working as assistants with B. Uma Devi, who resides at Villa No.182, MAK Project. On 30.3.2016, the 2nd respondent cleaned the Villa and stayed there. In the night time, the petitioners knocked the door. When the 2nd respondent opened the door, the petitioners quarrelled with her and abused her in filthy language in the name of her caste. When her daughter and brother-in-law came to rescue her, the petitioners abused them also.

Learned Counsel for the petitioners submitted that there are no specific allegations against the petitioners and that there were disputes between the petitioners and their landlords and that the management of the said Villa got filed the present complaint through the 2nd respondent falsely.

Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners. However, the 1st respondentpolice are directed to complete the investigation and file a final report, if any, without arresting the petitioners. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioners to appear before the investigating agency for the purpose of

investigation. On issuance of such notice, the petitioners are directed to appear before the investigating agency and give an undertaking as to their future appearance as and when required for the purpose of investigation.
