THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9171 of 2017 ORDER:

This Writ Petition is filed challenging the action of respondents 2 to 4 in not finalizing e-procurement tender process with regard to Item 1, 3 to 7 and 9 to 12 in ET 108/2016-2017, wherein the first petitioner society participated with regard to Item 1 to 11.

In the counter-affidavit filed on behalf of 2nd respondent, it is stated that the e-tender filed by the petitioners were not opened and finalized due to administrative grounds. The contract period of petitioners' societies expired in February, 2016 and it would take time to call for tender and labour. It is stated that the labour provided by the petitioners' societies are being continued as contract workers to maintain smooth flow functioning of the department. Since, only single bid was received for e-tender, the binds of the petitioners were not opened.

In view of the said statement made by the 2nd respondent in the counter-affidavit, if the workers deputed by the petitioners are being continued, the respondents shall not be removed without calling for fresh tender, for the work that is being discharged by them.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
