THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.477 OF 2008 ORDER:

This writ petition was filed seeking a direction to the first respondent to consider the case of the petitioners for absorption into aided post as recommended by the respondents 2 and 3.

This Court, by order, dated 07.09.2010, granted interim direction to the respondents 1 to 3 to ensure payment of the minimum pay scale applicable to teachers to the petitioners, pending further orders. Now a counter affidavit is filed stating that based on the report submitted by the respondents 2 and 3 to the Government on 31.12.2003, the Government examined the same and issued orders rejecting the claim of the petitioners in Memo No.11154/PS-1/2004-1, dated 27.01.2005, as School Management violated the establishment procedure laid down in G.O.Ms.No.524, dated 20.12.2008. In view of the subsequent order, dated 27.01.2005, of the first respondent, nothing survives in the present writ petition. However, it is open to the petitioners to take appropriate steps, if they so choose, challenging the said order.

The writ petition is accordingly dismissed as infructuous. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
