THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8152 of 2023 ORDER:

1.

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.280 of 2019 on the file of Korutla Police Station, Jagtial District, registered for the offence punishable under Section 306 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

3.

The petitioner is apprehending arrest in Crime No.280 of 2019 registered for the offence under Section 306 of IPC. It is alleged in the complaint that the petitioner, who was working as Manager in Vyshnavi Hospital, where the deceased was working had put pressure on the deceased as his superior in work related issues. The father of the deceased suspected that on account of the pressure put up by this petitioner, the deceased might have committed suicide.

The petitioner filed Crl.P.No.5354 of 2019 and at the stage of admission, this Court granted relief to the petitioner directing the Police not to take

any coercive steps against him. However, the said Criminal Petition was dismissed on 24.06.2022.

4.

Learned counsel appearing for the petitioner would submit that on account of the dismissal of the criminal petition, the Police are now trying to arrest the petitioner. 5.

Keeping in view the earlier order of this Court directing the Police not to take coercive steps against this petitioner, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:

1) The petitioner/Accused is directed to surrender before the Station House Officer, Korutla Police Station, Jagtial District, on 02.09.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused shall appear before the concerned Station House Officer at 10.00 A.M on every Monday and Wednesday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and

shall co-operate with the Investigating Officer in investigating the case.

6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
